Contrary to common beliefs, the history of the Luxembourg Council of State is not limited to the 1856 anti-parliamentary coup or to the image of a rigid and reactionary institution. This book offers a nuanced rereading of its origins and its first decades, from 1848 to 1878, a pivotal period when the political balance of the young state took shape. Drawing on unpublished and often overlooked sources, the author highlights an institution marked by tensions, debates, and rivalries, far from oversimplified representations. At the crossroads of national and international influences, the Council of State emerges as a complex actor, embedded in the profound transformations of the 19th century. This book invites the reader to rediscover an essential chapter of Luxembourg's political and legal history, restoring the diversity of voices and issues that shaped its institutions. Marc Besch has served as Secretary General of the Council of State since 1998 and joined its Secretariat in 1990. Author of works on formal legislation, he teaches constitutional law and legislative drafting at the University of Luxembourg and the National Institute of Public Administration.
